A man who was shot multiple times during an arrest by immigration officers in central California pleaded not guilty on Monday to federal charges that he rammed his vehicle into two agents, prosecutors said.

A federal grand jury on Friday indicted Carlos Ivan Mendoza Hernandez, who has dual citizenship in El Salvador and Mexico, on two counts of assaulting a federal officer with a deadly weapon and one count of damaging government property.

Patrick Kolasinski, one of his lawyers, has said Mendoza panicked and tried to flee when Immigration and Customs Enforcement agents blocked his car and that he did not intend to run over anyone. Kolasinski also disputed claims by officials that his client was a suspected gang member wanted in El Salvador for questioning in relation to a murder.

Salvadoran court documents show he was acquitted of murder in El Salvador and Mendoza has denied ever being in a gang, his lawyer has said. He came to the U.S. in 2019 and has no criminal record, Kolasinski has said.

The U.S. Attorney’s Office said Monday that Mendoza has requested a jury trial. A status conference was set for July 27.

Mendoza is recovering after several surgeries for multiple gunshot wounds, including one to the jaw, his attorney said.

The Department of Homeland Security has said ICE officers fired defensive shots at Mendoza after he tried to drive into them. DHS said the officers were conducting an enforcement stop targeting Mendoza, 36, on April 7 in Patterson, a city about 75 miles (120 kilometers) southeast of San Francisco.

It was part of a series of shootings that have occurred during the Trump administration’s aggressive push to detain and deport immigrants in the country illegally. It is also among those where questions have been raised to federal officials about the circumstances since in some shootings, video evidence contradicted immigration officials’ initial accounts.

Jacobo Melcer, 85, admitted to paying kickbacks to companies in exchange for referrals of Medicare beneficiaries and prescriptions for durable medical equipment Melcer’s companies sold, such as back, wrist and knee braces.

Those prescriptions were signed by physicians who were not regularly treating or had medically evaluated the beneficiaries, according to the U.S. Attorney’s Office.

Melcer’s plea agreement includes admissions to billing Medicare $5,885,382 and receiving $3,479,303. He also admitted pay over $227,000 in kickbacks.

Melcer is due to be sentenced in October following his plea to conspiracy to commit health care fraud and pay illegal renumerations. His guilty plea involves an agreement to pay restitution in the amount of the $3,479,303 he fraudulently received.

A Southern California man pleaded guilty Monday in downtown Los Angeles to a federal charge for hosting illegal cockfights in which owners paid $1,000 to register roosters expected to fight to the death while spectators gambled on the bloody results.

Isidro Chaparro Sanchez, 59, of Corona, entered a plea to one count of conspiracy to sponsor and exhibit roosters in an animal fighting venture, a felony carrying a possible sentence of up to five years imprisonment, according to the U.S. Attorney’s Office.

U.S. District Judge R. Gary Klausner set sentencing for July 17.

According to federal prosecutors, Sanchez conspired with four others to produce daylong cockfighting events on Sundays at a home on Duffy Street in San Bernardino for about four months last year. The location included a cockfighting ring with seating and bars serving tacos and alcoholic drinks.

Prosecutors say attendees parked — at the cost of $20 — at a different location nearly 1 mile away from the event location. They were then shuttled to the cockfighting location, where they paid $40 to enter the arena where the fights took place. Attendees could also place bets on the cockfights and participate in a raffle.

A team registering four roosters would pay an entry fee of $1,000. One of the co-defendants would collect the money, register the team’s roosters for battle, and record the weights of the roosters, papers filed in Los Angeles federal court show.

Attendees, including those who had registered their roosters, would place bets with bookmakers who collected the cash, Sanchez’s plea agreement filed in Los Angeles federal court says.

The blood sport on Duffy Street ended on Aug. 4, 2024, shortly after the arrival of almost 60 patrons, some carrying roosters. Before the first bout, special agents with the FBI armed with a search warrant raided the place.

Items seized included roughly $9,000 in cash, 50 to 100 sharp instruments or “gaffs” — curved metal spurs or blades that are attached to a rooster’s leg prior to a fight — and various types of steroids. In addition, about 200 birds, of which more than 150 were deemed to be fighting roosters by a local animal control agency, were recovered, according to the U.S. Attorney’s Office.

The four co-defendants face trial in June.

Cockfighting is a contest in which a person attaches a knife, gaff or other sharp instrument to the leg of a “gamecock” or rooster and then places the bird a few inches away from a similarly armed rooster. This results in a violent fight during which the roosters flap their wings and jump while stabbing each other with the weapons that are fastened to their legs. A cockfight ends when one rooster is dead or refuses to continue to fight. Usually, one or both roosters die after a fight, according to the U.S. Department of Justice.

President Joe Biden pardoned his son, Hunter, sparing the younger Biden a possible prison sentence for federal felony gun and tax convictions and reversing his past promises not to use the extraordinary powers of the presidency for the benefit of his family.

The Democratic president had previously said he would not pardon his son or commute his sentence after convictions in the two cases in Delaware and California. The move on Sunday night comes weeks before Hunter Biden was set to receive his punishment after his trial conviction in the gun case and guilty plea on tax charges, and less than two months before President-elect Donald Trump is set to return to the White House.

It caps a long-running legal saga for the younger Biden, who publicly disclosed he was under federal investigation in December 2020 — a month after his father’s 2020 victory — and casts a pall over the elder Biden’s legacy.

Biden, who time and again pledged to Americans that he would restore norms and respect for the rule of law after Trump’s first term in office, ultimately used his position to help his son, breaking his public pledge to Americans that he would do no such thing.

President Joe Biden, wearing a Team USA jacket and walking with his son Hunter Biden, heads toward Marine One on the South Lawn of the White House in Washington, July 26, 2024. (AP Photo/Susan Walsh, File)

In a statement released Sunday evening, Biden said, “I believe in the justice system, but as I have wrestled with this, I also believe raw politics has infected this process and it led to a miscarriage of justice.”

The president’s sweeping pardon covers not just the gun and tax offenses against the younger Biden, but also any other “offenses against the United States which he has committed or may have committed or taken part in during the period from January 1, 2014 through December 1, 2024.”

In June, Biden categorically ruled out a pardon or commutation for his son, telling reporters as his son faced trial in the Delaware gun case, “I abide by the jury decision. I will do that and I will not pardon him.”

As recently as Nov. 8, days after Trump’s victory, White House press secretary Karine Jean-Pierre ruled out a pardon or clemency for the younger Biden, saying, “We’ve been asked that question multiple times. Our answer stands, which is no.”

The elder Biden has publicly stood by his only living son as Hunter descended into serious drug addiction and threw his family life into turmoil before getting back on track in recent years. The president’s political rivals have long used Hunter Biden’s myriad mistakes as a political cudgel against his father: In one hearing, lawmakers displayed photos of the drug-addled president’s son half-naked in a seedy hotel.

House Republicans also sought to use the younger Biden’s years of questionable overseas business ventures in a since-abandoned attempt to impeach his father, who has long denied involvement in his son’s dealings or benefiting from them in any way.

“The charges in his cases came about only after several of my political opponents in Congress instigated them to attack me and oppose my election,” Biden said in his statement. “No reasonable person who looks at the facts of Hunter’s cases can reach any other conclusion than Hunter was singled out only because he is my son.”

President Joe Biden accompanied by his son Hunter Biden and his grandson Beau leave a book store as they walk in downtown Nantucket Mass., Friday, Nov. 29, 2024. (AP Photo/Jose Luis Magana)

“I hope Americans will understand why a father and a President would come to this decision,” Biden added, claiming he made the decision this weekend.

The president had spent the Thanksgiving holiday in Nantucket, Massachusetts, with Hunter and his family, and departed for Angola later Sunday on what may be his last foreign trip as president before leaving office on Jan. 20, 2025.

Hunter Biden was convicted in June in Delaware federal court of three felonies for purchasing a gun in 2018 when, prosecutors said, he lied on a federal form by claiming he was not illegally using or addicted to drugs.

He had been set to stand trial in September in the California case accusing him of failing to pay at least $1.4 million in taxes. But he agreed to plead guilty to misdemeanor and felony charges in a surprise move hours after jury selection was set to begin.

David Weiss, the Trump-appointed U.S. attorney in Delaware who negotiated the plea deal, was subsequently named a special counsel by Attorney General Merrick Garland to have more autonomy over the prosecution of the president’s son.

Hunter Biden said he was pleading guilty in that case to spare his family more pain and embarrassment after the gun trial aired salacious details about his struggles with a crack cocaine addiction.

President Joe Biden with his son Hunter Biden and his grandson Beau walk in downtown Nantucket Mass., Friday, Nov. 29, 2024. (AP Photo/Jose Luis Magana)

The tax charges carry up to 17 years behind bars and the gun charges are punishable by up to 25 years in prison, though federal sentencing guidelines were expected to call for far less time and it was possible he would have avoided prison time entirely.

Hunter Biden was supposed to be sentenced this month in the two federal cases, which the special counsel brought after a plea deal with prosecutors that likely would have spared him prison time fell apart under scrutiny by a judge. Under the original deal, Hunter was supposed to plead guilty to misdemeanor tax offenses and and would have avoided prosecution in the gun case as long as he stayed out of trouble for two years.

But the plea hearing quickly unraveled last year when the judge raised concerns about unusual aspects of the deal. The younger Biden was subsequently indicted in the two cases.

Hunter Biden’s legal team this weekend released a 52-page white paper titled “The political prosecutions of Hunter Biden,” describing the president’s son as a “surrogate to attack and injure his father, both as a candidate in 2020 and later as president.”

FILE – Hunter Biden steps into a vehicle as he leaves federal court, Sept. 5, 2024, in Los Angeles, after pleading guilty to federal tax charges. (AP Photo/Eric Thayer, File)

The younger Biden’s lawyers have long argued that prosecutors bowed to political pressure to indict the president’s son amid heavy criticism by Trump and other Republicans of what they called the “sweetheart” plea deal.

Rep. James Comer, one of the Republican chairmen leading congressional investigations into Biden’s family, blasted the president’s pardon, saying that the evidence against Hunter was “just the tip of the iceberg.”

“It’s unfortunate that, rather than come clean about their decades of wrongdoing, President Biden and his family continue to do everything they can to avoid accountability,” Comer said on X, the website formerly known as Twitter.

Biden is hardly the first president to deploy his pardon powers to benefit those close to him.

In his final weeks in office, Trump pardoned Charles Kushner, the father of his son-in law, Jared Kushner, as well as multiple allies convicted in special counsel Robert Mueller’s Russia investigation. Trump over the weekend announced plans to nominate the elder Kushner to be the U.S. envoy to France in his next administration.

Trump, who has pledged to dramatically overhaul and install loyalists across the Justice Department after he was prosecuted for his role in trying to subvert the 2020 presidential election, said in a social media post on Sunday that Hunter Biden’s pardon was “such an abuse and miscarriage of Justice.”

“Does the Pardon given by Joe to Hunter include the J-6 Hostages, who have now been imprisoned for years?” Trump asked, referring to those convicted in the violent Jan. 6, 2021 riot at the U.S. Capitol by his supporters.

Hunter Biden said in an emailed statement that he will never take for granted the relief granted to him and vowed to devote the life he has rebuilt “to helping those who are still sick and suffering.”

“I have admitted and taken responsibility for my mistakes during the darkest days of my addiction – mistakes that have been exploited to publicly humiliate and shame me and my family for political sport,” the younger Biden said.

Hunter Biden’s legal team filed Sunday night in both Los Angeles and Delaware asking the judges handling his gun and tax cases to immediately dismiss them, citing the pardon.

A spokesperson for Weiss did not respond to messages seeking comment Sunday night.

NBC News was first to report Biden was expected to pardon his son Sunday.

HOUSTON (AP) — An attorney said Tuesday he is representing 120 accusers who have come forward with sexual misconduct allegations against Sean “Diddy” Combs, the hip-hop mogul who is awaiting trial on sex trafficking charges.

Houston attorney Tony Buzbee said he expects lawsuits to be filed within the next month, with most expected to be filed in New York and Los Angeles. Buzbee described the victims as 60 males and 60 females, and that 25 were minors at the time of the alleged misconduct. One individual alleged he was 9 years old when he was abused, Buzbee said. The allegations cover a period from 1991 to this year.

“This type of sexual assault, sexual abuse, sexual exploitation should never happen in the United States or anywhere else. This should have never been allowed to go on for so long. This conduct has created a mass of individuals who are injured, scared and scarred,” Buzbee said at a news conference.

Houston lawyer Tony Buzbee holds a news conference at his office announcing that he’s representing 120 accusers who have come forward with sexual misconduct allegations against Sean “Diddy” Combs, the hip-hop mogul who is awaiting trial on sex trafficking charges, Tuesday, Oct. 1, 2024, in Houston.
Following the announcement of the accusations in Texas, an attorney for Combs said the performer “cannot address every meritless allegation in what has become a reckless media circus.”

“That said, Mr. Combs emphatically and categorically denies as false and defamatory any claim that he sexually abused anyone, including minors,” attorney Erica Wolff said in a statement. “He looks forward to proving his innocence and vindicating himself in court, where the truth will be established based on evidence, not speculation.”

Buzbee said more than 3,280 individuals contacted his firm and alleged they were victimized by Combs and that after vetting the allegations, his firm decided to represent 120 people. Other cases are still being reviewed. He said some of his clients have spoken with the FBI.

The individuals that Buzbee’s firm is representing are from more than 25 states, with the majority from California, New York, Georgia and Florida.

The abuse that’s being alleged took place mostly at parties held in New York, California and Florida where individuals were given drinks that were laced with drugs, Buzbee said.

Some of the alleged conduct took place at auditions where “many times, especially young people, people wanting to break into the industry were coerced into this type of conduct in the promise of being made a star,” Buzbee said.

Combs, 54, has been locked up at the Metropolitan Detention Center in Brooklyn since pleading not guilty Sept. 17 to federal charges that he used his “power and prestige” to induce female victims into drugged-up, elaborately produced sexual performances with male sex workers in events dubbed “Freak Offs.”

Other alleged victims have already filed lawsuits against Combs that include allegations of sexual assault.

Combs has pleaded not guilty to racketeering conspiracy and sex trafficking. His attorney said he is innocent and will fight to clear his name.

Combs is one of the best-known music executives, producers and performers across hip-hop, having won three Grammys and worked with artists such as Notorious B.I.G., Mary J.
By ERIC TUCKER, ALANNA DURKIN RICHER and ADRIANA GOMEZ LICON

MIAMI (AP) — Donald Trump became the first former president to face a judge on federal charges as he pleaded not guilty in a Miami courtroom Tuesday to dozens of felony counts accusing him of hoarding classified documents and refusing government demands to give them back.

The history-making court date, centered on charges that Trump mishandled government secrets that as commander-in-chief he was entrusted to protect, kickstarts a legal process that will unfold at the height of the 2024 presidential campaign and carry profound consequences not only for his political future but also for his own personal liberty.

Trump approached his arraignment with characteristic bravado, posting social media broadsides against the prosecution from inside his motorcade en route to the courthouse and insisting — as he has through years of legal woes — that he has done nothing wrong and was being persecuted for political purposes. But inside the courtroom, he sat silently, scowling and arms crossed, as a lawyer entered a not guilty plea on his behalf in a brief arraignment that ended without him having to surrender his passport or otherwise restrict his travel.

The arraignment, though largely procedural in nature, was the latest in an unprecedented reckoning this year for Trump, who faces charges in New York arising from hush money payments during his 2016 presidential campaign as well as ongoing investigations in Washington and Atlanta into efforts to undo the results of the 2020 race.

Always in campaign mode, he swiftly pivoted from the solemn courtroom to a festive restaurant, stopping on his way out of Miami at Versailles, an iconic Cuban spot in the city’s Little Havana neighborhood where supporters serenaded Trump, who turns 77 on Wednesday, with “Happy Birthday.” The back-to-back events highlight the tension for Trump in the months ahead as he balances the pageantry of campaigning with courtroom stops accompanying his status as a twice-indicted criminal defendant.

Yet the gravity of the moment was unmistakable.

Until last week, no former president had ever been charged by the Justice Department, let alone accused of mishandling top-secret information. The indictment unsealed last week charged Trump with 37 felony counts — many under the Espionage Act — that accuse him of illegally storing classified documents in his bedroom, bathroom, shower and other locations at Mar-a-Lago and trying to hide them from the Justice Department as investigators demanded them back. The charges carry a yearslong prison sentence in the event of a conviction.

Trump has relied on a familiar playbook of painting himself as a victim of political persecution. He attacked the Justice Department special counsel who filed the case as a “thug” and “deranged,” pledged to remain in the race no matter what and addressed supporters Tuesday night at his Bedminster, New Jersey, golf club, where he delivered a roughly half-hour speech full of repeated falsehoods and incendiary rhetoric and threatened to go after President Joe Biden and his family if elected.

“The seal is broken by what they’ve done. They should never have done this,” Trump said of the indictment.

But Attorney General Merrick Garland, an appointee of President Joe Biden, sought to insulate the department from political attacks by handing ownership of the case last November to a special counsel, Jack Smith, who on Friday declared, “We have one set of laws in this country, and they apply to everyone.”

Smith attended Tuesday’s arraignment, sitting in the front row behind his team of prosecutors.

The court appearance unfolded against angst over potential protests, with some high-profile backers using barbed rhetoric to voice support. Though city officials said they prepared for possible unrest, there were few signs of significant disruption.

Trump didn’t say a word during the court appearance, other than to occasionally turn and whisper to his attorneys who were seated on either side of him. He fiddled with a pen and clasped his hands on the table in front of him as the lawyers and the judge debated the conditions of his release.

While he was not required to surrender a passport — prosecutors said he was not considered a flight risk — the magistrate judge presiding over the arraignment directed Trump to not discuss the case with certain witnesses. That includes Walt Nauta, his valet who was indicted last week on charges that he moved boxes of documents at Trump’s direction and misled the FBI about it.

Nauta did not enter a plea Tuesday because he did not have a local lawyer with him.

Trump attorney Todd Blanche objected to the idea of imposing restrictions on the former president’s contact with possible witnesses, noting they include many people close to Trump, including staff and members of his protection detail.

“Many of the people he interacts with on a daily basis — including the men and women who protect him — are potential witnesses in this case,” Blanche said.

Trump, who has repeatedly insisted that he did nothing wrong, showed no emotion as he was led by law enforcement out of the courtroom through a side door.

Even for a man whose presidency and post-White House life have been defined by criminal investigations, the documents probe had long stood out both because of the volume of evidence that prosecutors had seemed to amass and the severity of the allegations.

A federal grand jury in Washington had heard testimony for months, but the Justice Department filed the case in Florida, where Trump’s Mar-a-Lago resort is located and where many of the alleged acts of obstruction occurred.

Though Trump appeared Tuesday before a federal magistrate, the case has been assigned to a District Court judge he appointed, Aileen Cannon, who ruled in his favor last year in a dispute over whether an outside special master could be appointed to review the seized classified documents. A federal appeals panel ultimately overturned her ruling.

It’s unclear what defenses Trump is likely to invoke as the case moves forward. Two of his lead lawyers announced their resignation the morning after his indictment, and the notes and recollections of another attorney, M. Evan Corcoran, are cited repeatedly throughout the 49-page charging document, suggesting prosecutors envision him as a potential key witness.

The indictment Friday accuses Trump of illegally retaining national security documents that he took with him from the White House to Mar-a-Lago after leaving office in January 2021. The documents he stored, prosecutors say, included material on nuclear programs, defense and weapons capabilities of the U.S. and foreign governments and a Pentagon “attack plan,” prosecutors say. He is accused of showing off some to people who didn’t have security clearances to view them.

Beyond that, according to the indictment, he repeatedly sought to obstruct government efforts to recover the documents, including by directing Nauta to move boxes and also suggesting to his own lawyer that he hide or destroy documents sought by a Justice Department subpoena.

___
