<p class="wp-block-paragraph">On January 13, 2023, at 12:30 AM, deputies from <a href="https://www.riversidesheriff.org/743/Lake-Elsinore-Station">the Lake Elsinore Sheriff’s Station</a> responded to the 15700 block of Grand Avenue, Lake Elsinore, regarding an intoxicated subject, possibly under the influence of narcotics. Upon arrival, deputies located Andy Dick (67 years old), a resident of the city of Hemet, displaying signs of being under the influence of alcohol. Dick was arrested without incident. During a routine records check it was determined, Dick was a registered sex offender who was not up-to-date on his registration. Dick was booked into the Cois Byrd Detention Center on the charges of being under the influence of alcohol in public (public intoxication) and failing to register as a sex offender.</p>

<p class="wp-block-paragraph">POMONA, Calif. (AP) — A convicted child rapist pleaded no contest Monday to sexually assaulting and killing two young boys in the 1980s in Southern California.</p>



<p class="wp-block-paragraph">Kenneth Rasmuson, 59, entered pleas to two counts of murder with the special circumstance that he committed multiple killings. He is expected to be sentenced to life in prison without possibility of parole on April 27.</p>



<p class="wp-block-paragraph">The case was marked by conflict over District Attorney George Gascón&#8217;s reform policies — which in general bar the filling of special-circumstance allegations — and prompted the DA of neighboring Orange County to file his own case against Rasmuson out of concern that he might one day be eligible for parole.</p>



<p class="wp-block-paragraph">Rasmuson was accused of abducting and killing 6-year-old Jeffrey Vargo, who disappeared on July 2, 1981 after he left his house in Anaheim Hills in <a href="https://www.ocgov.com/">Orange County </a>to look at a fireworks stand.</p>



<p class="wp-block-paragraph">His body was found the next day at a construction site in Pomona, in <a href="http://www.elarc.org/">eastern L.A. County</a>.</p>



<p class="wp-block-paragraph">“We are finally putting an end to this,” Jeffrey Vargo&#8217;s mother, Connie Vargo, said at a news conference. “I just wanted it to be over.”</p>



<p class="wp-block-paragraph">Rasmuson also was accused of kidnapping, stabbing and strangling 6-year-old Miguel Antero, who vanished on April 8, 1986 after stepping off of a school bus near his Agoura Hills home. His body was found that day in a wash near his home in the northwestern county.</p>



<p class="wp-block-paragraph">Decades later, DNA evidence linked Rasmuson to the slayings, prosecutors said. In 2015, he was arrested at his parents&#8217; home Sandpoint, Idaho, where he had been living as a registered sex offender.</p>



<p class="wp-block-paragraph">Rasmuson spent 17 years in prison for the 1980s molestation of an 11-year-old boy in <a href="https://www.countyofsb.org/">Santa Barbara County</a> and a 3-year-old Los Angeles boy. After serving his time, he was committed to a state mental hospital as a dangerous sex offender but was released in 2007.</p>



<p class="wp-block-paragraph">Because he was charged with murder with special circumstances, Rasmuson could have been eligible for the death penalty. However, Gascón has barred prosecutors from seeking the death penalty on grounds that a capital sentence could lead to decades of costly appeals with little chance of an execution.</p>



<p class="wp-block-paragraph">California hasn’t executed anyone since 2006. There are currently more than 700 people on California’s death row and Gov. Gavin Newsom has put a moratorium on executions so long as he is governor.</p>



<p class="wp-block-paragraph">Gascón last year also barred prosecutors in general from filling special circumstance allegations that can add prison time but under community pressure he later made an exception in certain cases, including those involving child sexual abuse. Several judges also had blocked his office&#8217;s attempts to dismiss sentencing enhancements.</p>



<p class="wp-block-paragraph">Last week, Orange County District Attorney Todd Spitzer said he also was charging Rasmuson with the killing of Jeffrey Vargo out of concern that Gascón intended to drop the special circumstance allegation.</p>



<p class="wp-block-paragraph">“This was a heinous offense and this individual will not share the sidewalk with the rest of us,” Gascón said in a statement. “The defendant was always facing life in prison,&#8221; and noted that the special circumstance allegation hadn&#8217;t been dismissed “due to a recent court ruling.&#8221;</p>

<p class="wp-block-paragraph">On Friday, October 30, 2020, deputies from the <a class="rank-math-link" href="https://www.riversidesheriff.org/">Riverside County Sheriff’</a>s Department, Cabazon Station conducted a Sex Offender Compliance Operation involving sex registrants residing in the communities of Cherry Valley, Cabazon, Whitewater, and the city of Calimesa.  Deputies conducted compliance checks on 21 registered Sex Offenders who reside within these communities.</p>



<p class="wp-block-paragraph">As a result of these compliance checks, it was found that one registrant was out of compliance and he had moved from his last registered address. A criminal investigation is being conducted into his current whereabouts and charges will be filed with the District Attorney’s Office.</p>



<p class="wp-block-paragraph">Twenty subjects were contacted and found to be in compliance with their sex offender registration.</p>



<p class="wp-block-paragraph">The <a class="rank-math-link" href="https://www.facebook.com/RCSD.Cabazon/">Cabazon Sheriff’s</a> Station will continue to monitor and conduct random compliance checks of all registered sex offenders within these communities.</p>

<p class="wp-block-paragraph">Mr. Smith has left the City of Lake Elsinore. <p class="wp-block-paragraph">Sex Offender Released from State Mental Hospital currently in Lake Elsinore, CA.</p>



<p class="wp-block-paragraph">Cary Jay Smith, 59, was sent to <a href="https://www.dsh.ca.gov/Patton/index.html">Patton State Hospital</a> in San Bernardino in 1999 on a 72-hour psychiatric hold after his wife provided a psychiatrist with a letter in which Smith described sex acts he wanted to perform on a 7-year-old boy who lived in his Costa Mesa neighborhood.</p>



<p class="wp-block-paragraph">Since 1999, Smith has continued to be held by the state under a section of the state’s <a href="https://leginfo.legislature.ca.gov/faces/codesTOCSelected.xhtml?tocCode=wic">Welfare and Institutions Code</a> (WIC) as a result of a series of civil trials which have determined that he presents a “demonstrated danger of inflicting substantial physical harm” to children. Under WIC 5300, Smith is allowed a new trial every six months to demonstrate that he is no longer a danger to society.</p>



<p class="wp-block-paragraph">During those hearings, Smith has repeatedly testified that he fantasizes about raping and then killing young boys in order to avoid being identified. He claims that he has killed three boys and molested 200. He prefers to go by the name Mr. RTK, which stands for rape, torture, kill.</p>



<p class="wp-block-paragraph">Psychologists have testified over the years that Smith posed an imminent danger. The state hospital did not renew the 5300 hold against Smith, allowing it to expire on Saturday, July 11, 2020. The Orange County District Attorney urged Governor Newsom to intervene and reinstate the requirement that Smith register as a sex offender. Smith is not on probation or parole and his requirement to register as a sex offender for life was removed by the State in 2005 for reasons that remain unclear.</p>



<p class="wp-block-paragraph">Following his release from <a href="https://www.dsh.ca.gov/Coalinga/">Coalinga State Hospital</a>, Smith returned to the Orange County area, then to Corona, relocating to local motels on a daily basis. <a href="https://www.cityoforange.org/592/Police">The Orange Police Department</a> and <a href="https://www.coronaca.gov/services/police-department">Corona Police Department</a> have monitored Smith while he temporarily resided in their cities since his release and have been sharing information to maintain community safety. Deputies from the Riverside County Sheriff&#8217;s Department are currently monitoring Smith to ensure the safety of our communities. We will continue to do so as long as he is within the County of Riverside. Mr. Smith is not on any form of supervised release or required to register as a sex offender. Smith can move around without restrictions. We will update the community when he leaves.</p>

<p class="wp-block-paragraph">Over the course of the last year, an unprecedented number of inmates have been released by the State of California. Upwards of 10,000 have already been released, with plans to release 8,000 more by the end of August, according to a July 10th press release by California Department of Corrections and Rehabilitation. Law enforcement officials have appealed to the State and the Governor to prevent the mass release of violent inmates and sexual predators, however they have continuously failed to do so.</p>



<p class="wp-block-paragraph">Please note: the purpose of the release of this information is to allow members of the public to protect themselves and their children from sex offenders. (Penal Code section 290.45 (a)(2)) Any use of this information other than for the stated purpose is unlawful.</p>

The Orange County District Attorney urged Governor Newsom to intervene and reinstate the requirement that Smith register as a sex offender. Smith is not on probation or parole and his requirement to register as a sex offender for life was removed by the State in 2005 for reasons that remain unclear. &nbsp;</p>



<p class="wp-block-paragraph">Following his release from <a href="https://www.dsh.ca.gov/Coalinga/">Coalinga State Hospital</a>, Smith returned to the Orange County area, then to Corona, relocating to local motels on a daily basis. The Orange Police Department and Corona Police Department have monitored Smith while he temporarily resided in their cities since his release and have been sharing information to maintain community safety. Deputies from the Riverside County Sheriff’s Department are currently monitoring Smith to ensure the safety of our communities. We will continue to do so as long as he is within the County of Riverside. Mr. Smith is not on any form of supervised release or required to register as a sex offender. Smith can move around without restrictions. We will update the community when he leaves.</p>

<p class="wp-block-paragraph">Over the course of the last year, an unprecedented number of inmates have been released by the State of California. Upwards of 10,000 have already been released, with plans to release 8,000 more by the end of August, according to a July 10th press release by California Department of Corrections and Rehabilitation. Law enforcement officials have appealed to the State and the Governor to prevent the mass release of violent inmates and sexual predators, however they have continuously failed to do so.&nbsp;</p>



<p class="wp-block-paragraph">Please note: the purpose of the release of this information is to allow members of the public to protect themselves and their children from sex offenders. (Penal Code section 290.45 (a)(2)) Any use of this information other than for the stated purpose is unlawful.</p>



<p class="wp-block-paragraph">Do not contact, confront, or attempt to apprehend Mr. Smith if seen.</p>
